What is the GDPR?

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, Official Journal of the European Union L. of 2016, No. 119).

We have been applying the GDPR since 25 May 2018.

What are “personal data”? When are they transferred?

Personal data within the meaning of the Directive are any information relating to an identified or identifiable natural person. The concept of personal data includes information which is accessible or recorded in any form (e.g. alphabetical, numerical, graphic, sound), stored on traditional media (paper, etc.) or on electronic media (magnetic and other disks).

Personal data are in particular: name and surname, identification number, location data, online identifier or other data that enable the identification of a natural person.

To the extent that you use our website, it uses cookies to compile statistics and to facilitate the use of it. These data may constitute personal data. Users can manage their storage via their web browser settings.

If we use the forms posted by us to contact you, we take care to provide you with information that your personal data will be processed for the purposes of contact, correspondence and exchange/transmission of necessary information.

In addition, personal data are also transferred in connection with the conclusion of contracts or the exercise of rights, both in your and our company’s interest.

What is the purpose of the GDPR?

The purpose of the GDPR is to contribute to an increase in the level of protection of personal data and to facilitate their transfer in order to make the idea of the information society more and more effective.

What is the purpose of the data we collect?

We obtain your personal data at the time of concluding a contract or in connection with our business, i.e. for the purpose of:

  • entering into and performing a contract between us and ensure an adequate level of services provided, throughout its entire period and thereafter, in connection with settlements and obligations incumbent on our company in relation to reporting, accounting, tax and information obligations, including the availability of our services;
  • fulfilling legal obligations arising from the provisions of law, including issuing invoices and other documents, ensuring the proper quality of services, as well as conducting and responding to complaints;
  • determining and protecting our claims, preventing violations, abuses and criminal activities;
  • verifying the ability to meet financial obligations towards our company;
  • direct marketing of the services offered by our company;

Apart from restricting access to our services or provision of services, due to the non-payment of our receivables, we do not plan the automatic processing of the data provided to us (profiling). Should such circumstances arise, we will inform you about them separately.

When will the data be processed?

The personal data provided to us will be processed during the term and performance of concluded contracts or efforts to conclude them, the performance of obligations incumbent on us under the law or during the performance of legitimate interests related, for example, to the defence of our rights against state authorities and for the period in which marketing actions are permitted.

What data do we process?

All personal data collected are related to the conclusion and performance of contracts within the scope of our business or the fulfilment of the legitimate obligations of our company and are used for this purpose. The data collected are limited to what is necessary for the conduct of our business and the performance of our obligations.

Transmission for processing or making available of data

Your data may be outsourced for processing on our behalf only within the limits of the law, for example to:

  • operate, service and maintain the systems we use;
  • subcontractors carrying out works commissioned by us for the performance of contracts between us;
  • entities providing advisory, legal and other services to us.

The data may also be made available to other entities that process the data provided to them on their own behalf, such as:

  • entities providing postal or courier, logistic and transport services;
  • payment institutions, banks making payments;
  • debt collectors, if our receivables are not paid on time;
  • other bodies and entities operating under the law.

We do not currently plan to transfer your data outside the European Economic Area to third countries.

Types of rights you have in relation to the processing of data

You have the right to:

  • rectify data when they are incorrect or erroneous;
  • have your data erased where the processing has no legal basis;
  • restrict the processing of personal data - withhold operations or prevent deletion of data, on the basis of the request;
  • access to data - information about the processed data and their content;
  • transfer data to another controller or to you.

Objection

You have the right to object to the processing of personal data for the purpose of direct marketing, with the result that the processing of data for this purpose is discontinued.

In other cases, due to your legitimate interest, we will discontinue the processing of your data unless there are legal grounds for their processing such as assertion of claims or other legitimate reasons on the part of our Company.

Consent - the effects of its expression and withdrawal

If the processing of data by us takes place with your consent (i.e. in situations other than the conclusion and performance of a contract), you may withdraw your consent at any time, but this does not affect the lawfulness of the processing activities carried out until the withdrawal of consent.

Complaint to the supervisory authority

If you believe that the processing of personal data by our company violates the law, you may lodge a complaint with the President of the Personal Data Protection Office.
